Terms of Service

1. Acceptance

By creating an account at checkthatphone.com or making any request to the CheckThatPhone API, you agree to be bound by these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.

2. Definitions

  • Customer — you or the entity you represent.
  • Service — the CheckThatPhone API, website, and dashboard.
  • API Key — the secret bearer token issued from your dashboard, used to authenticate API requests.
  • Credit — the unit of API consumption. A standard lookup costs 1 credit. Add-on features cost an additional credit each (see Section 6).

3. Account Registration

You must provide accurate and complete information when registering, keep your password and API keys confidential, and promptly notify us of any unauthorized use of your account. You may not share an account, and each account is for use by a single individual or entity.

4. API Access and Use

Your API key authenticates all requests on your behalf. You are responsible for all usage and charges incurred under your API key. If a key is exposed, revoke it from the dashboard immediately and issue a new one. We may revoke keys without notice if we detect suspected abuse or compromise.

5. Acceptable Use Policy

You may not use the service to:

  • Violate any law or regulation, including the Telephone Consumer Protection Act (TCPA) and equivalent state or international laws
  • Harass, stalk, intimidate, or target any specific individual
  • Attempt unauthorized access to our systems, other customers' data, or our upstream providers
  • Reverse-engineer, decompile, or disassemble the service
  • Scrape the website or dashboard outside of normal browser usage
  • Resell, sublicense, or redistribute API responses as a competing product without our written permission
  • Spam, send unsolicited communications, or use validation results to facilitate spam
  • Submit phone numbers you do not have a lawful basis to look up

Violations may result in account suspension or termination without refund.

6. Plans and Fees

Our current plans (all USD, current as of the "Last updated" date above):

  • Free — $0/month. 500 lookups per month, hard-capped. A valid card on file is required to verify the account and prevent abuse. To verify the card we place a temporary $1 authorization and release it immediately, so you are never actually charged, and the Free plan has no overage.
  • 1K — $5/month. 1,000 credits included; overage at $0.005 per credit.
  • 10K — $30/month. 10,000 credits included; overage at $0.003 per credit.
  • 100K — $100/month. 100,000 credits included; overage at $0.001 per credit.

Add-on features cost an additional credit per lookup:

  • TCPA litigator filter — +1 credit per lookup when enabled.
  • Landline SMS lookup — +1 credit when applied (only landlines).

Prices may change. We will notify active customers by email at least 30 days before any price increase takes effect on their account.

7. Billing and Payment

Paid subscriptions bill monthly via Stripe. Overage usage is metered throughout the period and pushed to Stripe daily. Subscription fees are charged on each renewal date; overage appears on the next invoice. Failed payments may result in a grace period followed by suspension of API access until payment is restored.

8. Plan Changes, Refunds, and Credits

Subscription fees and metered overage charges are non-refundable. We do not prorate, credit, or refund plan changes. Upgrades take effect immediately at the new plan's full rate and begin a new billing period; the unused remainder of your previous plan is not credited. Downgrades take effect at the end of your current billing period — you keep your current plan and its included credits until then, and no credit or refund is issued. We do not issue cash refunds for the unused remainder of a paid period.

9. Cancellation

You may cancel a paid subscription at any time from the billing page. API access continues until the end of the current paid period; we do not refund the unused portion. You may delete your account entirely by contacting hello@checkthatphone.com.

10. Termination by Us

We may suspend or terminate your access at any time for material breach of these Terms, violation of the Acceptable Use Policy, suspected fraud, chargebacks, or prolonged non-payment. We will notify you by email when reasonable to do so.

11. Service Availability

We operate the service on a best-effort basis. This version of the Terms does not include a contractual uptime SLA. The service depends on upstream providers, and we are not liable for outages, errors, or degradations originating with those providers. For accounts that need an SLA, contact us for an enterprise agreement.

12. Intellectual Property

We retain all rights, title, and interest in and to the service, including the website, API, dashboard, documentation, and all underlying software. You retain rights to the data you submit; you grant us a limited, non-exclusive license to process the phone numbers and IP addresses you submit solely to perform the lookups you request.

13. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Carriers do not guarantee actual SMS or call delivery; our action recommendations are advisory and not guarantees. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, CheckThatPhone shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, or lost data, arising from or related to your use of the service. Our total liability for any claim arising under or related to these Terms shall not exceed the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless CheckThatPhone and its operators from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your misuse of data retrieved through the service — including but not limited to TCPA, CCPA, or GDPR claims related to your outbound communications.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email to active account holders and noted with a new "Last updated" date. Continued use of the service after a change indicates acceptance of the updated Terms.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CheckThatPhone regarding the service and supersede any prior agreements relating to the same subject matter.
